TERMS AND CONDITIONS



Definitions:
 


Customer/Client - means the person who buys or agrees to buy the products/goods from the seller.
Conditions - means the terms and conditions of sale set out in this document and any special; terms and conditions agreed in writing by the seller. No Verbal agreements will be honoured unless put in writing.
Seller - means J Fire Safety.
Price - means the price for the services/products including delivery, packaging and VAT.
Contract - refers to any contract between the customer and J Fire Safety for the sale and purchase of products incorporating these conditions, whether completed electronically or through other means, this includes maintenance.

1. Installation work
a) All work will be carried out by a competent and experienced installer, under pinned by management training
b) Fire Doors- The door leaf and associated ironmongery provided are compliant with BS 9999 (door leaf), BS EN 1634-1: 2008 (door viewer), BS EN1634-1 (door closer), BS 476: Part 31.1: 1983 (intumescent seals), BS 476: Part 22: 1987 (letterbox), BS EN 1634-1: 2000 (locks and latches),
c) Fire Doors- A single coat of primer will be applied to the door. Tolerance has been allowed for 3 coats of paint on the door and frame and it is recommended that this is applied by either J Fire or a third party.
d) Fire Doors- J Fire Safety can provide a quote for additional primer and paint for the door, this is of an additional charge and is not included within the door cost.
e) J Fire Safety takes no responsibility for the thickness of paint supplied or applied to the door by any third party. You should ensure your third party decorator is aware of the regulations for the gap allowed around the finished product.

f) Fire Doors- Unless specified by the customer prior to installation works, J Fire Safety will select all brands of all products to be installed that meet requirements and meet British Standards.
g) Door frames - During installation there will be minor damage to door frames due to removing existing door and frame, and the reinstallation works. We will patch up with filler as best as possible however this will not be left to a professional decorators finish. Customers might have to carry out light redecoration to the area once J Fire have completed installation works.
h) Should you wish to make any changes to the services, then you must notify J Fire Safety in writing, 5 working days before the work is due to be carried out. J Fire Safety will confirm as to whether such changes are acceptable or not.
i) Fire Door- Re-decoration and final making good is excluded from quoted costs, unless specifically detailed as included.
j) J Fire safety takes no responsibility for the flooring surrounding the door area and any adjustment in floor heights resulting from the new door.
k) If a communal area is due for refurbishment the door tolerance will be made to the current internal measurement of the property, please contact us if you wish to change your floor heights, do not adjust the door yourself.
l) All doors will be provided with 3 keys, if you do not advise us otherwise then we will leave 2 keys with the tenant and send 1 to the landlord or in the case that you own and live in the property then all 3 keys will be left with the owner of the property. Should you wish to have additional keys we can provide these at an additional cost, please contact us for a quote.
m) Certificates for the door leaf and associated ironmongery will be released upon receipt of full payment.
n) BM Trada certificates will only be released upon receipt of full payment.
o) By accepting our quote, you are accepting our terms and conditions and agreeing to pay the quotation price and any extras that you ask for.
p) By accepting our quote, you confirm to have thoroughly read through the quote and you understand that you will pay the total amount including VAT. Please notify us if there is any part of the quote that you do not understand or if you have reading difficulties or visual impairments prior to any works starting.
q) The fixed contract begins when work commences.
r) J Fire Safety will remove any dust and materials caused by the work at the end of the working day.
s) Any defects to parts or damage to the installation must be reported within 1 month of completion of installation otherwise your warranty will not be valid.

t) J Fire Safety cannot be held responsible for the door gap adjustments after the warranty period has expired. These fall under wear and tear and adjustment/recalibration are charged at £275.00+VAT.

u) J Fire Safety cannot take responsibility for the floor covering changes which affect the fire door gap.

2. Pricing
a) For works separate to a contract, we require a 50% deposit which must be paid before the works are carried out. This deposit will be taken off of the final invoice amount and is strictly non refundable.
b) All deposits are strictly non refundable if works are cancelled by the customer. If any works are cancelled by J Fire Safety then a full refund of any monies paid will be made.
c) Contracts should be paid in full prior to the start date unless paying via Direct Debit which should be agreed upon signing the contract.
d) All figures quoted are subject to VAT at the prevailing rate.
e) Unless stated otherwise, the costs quoted assume standard working hours between the hours of 08:00 hrs - 17:00 hrs Monday to Friday inclusive. Work required outside of these hours may attract out of hours premium rates.
f) If the job is cancelled within 72 hours of the start date, this will attract a £100.00+VAT cancellations fee.

3. Warranty
a) The door leaf and and associated ironmongery has a warranty of 1 year unless third party damage is clearly evident in which case any remedial work will be chargeable.
b) Any damage to doors caused by moving furniture in and out of the property is not covered under any warranty.
c) J Fire Safety accepts no responsibility for any failure, negligence or actions of a third party including tampering with the door/ironmongery, this will also terminate the warranty.
d) Locks may be adjusted free of charge within 1 year of the door installation. After 1 year this will be chargeable.
e) Any damaged caused to the fire door must be reported and an inspection will be required to get compliance, we can do this for £75.00+Vat within a 10 mile radius,
f) Any door that falls out of tolerance due to wear and tear is not covered under warranty.                                                                                                                                                                g) Handles which are rusty, harmed by cleaning chemicals or damaged by any type of wear and tear are not covered in your warranty and will not be replaced free of charge.          h) Items screwed to the door (not by J Fire Safety) will terminate the warranty.                                                                                                                                                                                      i) Any obstruction to the drop bars will cause damage. Replacement drop bars on doors installed by J Fire Safety will charge £110.00+VAT.

4. Access
a) While works are taking place we will require access with either a key or from yourself or your tenant.
b) If an appointment is arranged and agreed, and upon arrival access is denied then there will be an additional charge to the owner of the property for £290.00+vat to cover our costs for the engineers cancelled day.

5. Fire alarm and emergency lighting contracts
a) The client shall be entitled to terminate the contract at any time by giving us no less than 11 months written notice to J Fire Safety.
b) The contract is valid for 12 months from the start date, J Fire Safety will send a quote for a renewal cost at least 1 month before the end date.
c) J Fire Safety will provide the service to the customer within working hours (extended hours if agreed in writing with the customer).
d) Unless agreed in writing by J Fire Safety, the price for the maintenance contract shall be the price set out in the contract.
e) We only provide call outs for properties that have a current valid contract with us, call outs between our working hours of Monday to Friday 8am - 5pm are charged at £75.00+vat per hour. Call outs out of hours Monday to Friday are charged at £105.00+vat per hour. Call outs for Saturdays and Sundays for 24 hours period are £120.00+vat per hour. Call outs for bank holidays for 24 hour period are charged at £140.00+vat per hour. Call outs for Christmas Eve/Day and New Years Eve/Day are charged at @205.00+vat per hour. Charges begin from the time the first engineer answers the phone and can be evidence with telephone records.
f) Any call outs that are temporarily fixed by an engineer giving advice over the phone and not resulting in a physical visit to the property that day are chargeable at £45.00+vat.
g) Annual testing of fire alarms will be scheduled with owners, landlords, tenants & property management companies and appointments booked with at least 1 week notice, failure to provide access to the engineer on the day of the booked appointment may result in an additional charge being applied for extra visits, this will be subject to our discretion.
h) The prices above are subject to change without notification and a minimum charge of 1 hour labour applies regardless of time spent at the property.

J Fire Safety operates with sister company J Electrical Services & Installations. Some accreditations are shared, some certificates and reports issued will be under the name of J Electrical Services. 

Should the Customer wish to cancel any contract, J Fire Safety must be notified in writing. No refunds will be given for any remaining time on the contract.

The invoice will be due 7 working days after the issue date (unless agreed otherwise), this must be paid within this time. Failure to do so may result in interest being applied and a small court claim made against you.
